The BBC reported this morning on “Scotland counting cost of storms” but in the aftermath of yesterday’s storm many people may be feeling the damage, and the cost, on a more personal level.

Facebook was awash with anecdotes of broken chimney stacks, shattered windows, fallen trees and even flying trampolines! There were also many posts contemplating at whose door liability for damage to property sustained in the storm rests and whose insurer should meet the costs. Take for example the situation where a tile falls from a neighbour’s house onto your car… is the claim to be met by your car insurer or your neighbour’s home insurer? The answer will almost certainly be your neighbour’s home insurer (providing of course they hold cover) – under their ‘personal and/or occupier’s liability’.
