How we helped our client
At the time of the accident, our client was wearing appropriate footwear for the task in hand, but there were no floor markings allowing safe passage for workers and vehicles. As a result he suffered two broken toes, one in each foot, when a vehicle ran over his feet. He was absent from work for a week after requiring stiches.
Despite our client’s employer initially instigating a disciplinary investigation into his role in the incident, we were able to prove that he was in no way at fault, and that unsafe working procedures had caused the accident. We also established that many, if not all, of the fork-life drivers were operating on licences which had not been adequately updated.
We commissioned an expert on foot injuries to provide a comprehensive report on the injuries sustained and we were able to negotiate an award at the top end of damages scale without the need to proceed to Court.
