Kim suffered from a broken wrist after teachers failed to take precautionary measures during a school running race

Kim was running in a race in the school gym. The teachers hadn’t marked out a finishing line, instead the race ended at the wall of the gym and so to stop, Kim had to put her hands out against the gym wall and as a result broke her wrist.

How we helped Kim

We recovered her school and medical records and notified a claim to the Education Authority. Their insurers denied liability. We raised court proceedings and had the gym inspected by an expert in physical education and he prepared a report critical of the teachers who organised the race. Soon after the case settled at £7,500.

Kim said:

My accident happened when I was 8. My mum and I had no idea that we could claim compensation from the Education Authority. Lindsays were dealing with an unrelated claim for me and they took the trouble to go through my medical records in connection with that and they spotted the accident at school. I never thought I would get compensation for my accident. It was a big bonus to get compensation for something I didn’t even know I could claim for. I would recommend Lindsays to anyone who has had an accident at school.

How we can help

We have a specialist team who have a vast amount of experience in dealing with accidents at school across a wide range of accidents including slips and trips, bullying, lack of supervision and occupier’s liability:

  • several members of the team are members of the Association of Personal Injury Lawyers (APIL). Through APIL we have access to a wide range of experts in the field of physical education, maintenance of the school playground and buildings and supervision;
  • you can claim for any accident at school up until your 19th birthday.
