We helped our client make a claim against the owners of a workshop who failed in their duty of care resulting in her permanent injury

Alice suffered an injury in a workplace accident which resulted in the loss of part of her middle finger. 

Alice is a qualified furniture maker who was injured as a result of a lack of safety equipment on a machine used to plane wood. The cutting blade was unguarded and there was no ‘kill switch’ installed, if there had been the machine would have stopped immediately on impact.

How we helped Alice

After intimating a claim on the owners of the workshop where Alice rented work-time, we were able to agree that they had failed in their duty of care to Alice and were liable for her injury. 

An expert report from a consultant plastic and hand surgeon on the permanent damage and scarring to Alice’s finger was obtained, and statements taken in relation to the effect on her personal and professional life.

As a newly operating self-employed furniture maker, it was difficult to substantiate Alice’s potential loss of earnings. However, by analysing her initial tax returns, we were able to agree settlement of £25,000, which is at the higher end of the scale applicable in the guidelines for personal injury awards, and in line with awards made previous cases which had progressed to Court.
