How we helped our client
Our client was a 43 year old mother who suffered serious physical and psychiatric injuries when a helicopter crashed into the building where she was enjoying a night out.
The impact caused severe damage to the building’s structure and our client was struck by a plank of wood on the side of her head. She was crushed to the ground by falling debris and trapped up to her shoulders. She suffered a severe head laceration and was left with chronic injuries to her neck and back, and psychiatric injury having lost a friend and work colleague in the tragedy.
The claim was intimated on the defenders, Bond Air Services Limited in terms of Section 76(2) of the Civil Aviation Act and liability was quickly established.
We were initially instructed as the Scottish Agents to raise protective proceedings after failed settlement negotiations between the parties’ respective English agents. The case was considered appropriate for jury trial and we facilitated arrangements for this through the All Scotland Personal Injury Court.
The defenders subsequently put forward an offer in the region of £20,000 which was considered too low given the extent of our client’s injuries. The case proceeded all the way to negotiations at the pre-trial meeting where we managed to secure a settlement of £40,000 for our client.
