GP negligence has been highlighted following the death of Sky Sports Presenter Simon Thomas’ wife late last year.

Simon’s wife had attended her GP three times over the course of six days complaining of being unwell. Her GP sent her home and told her to have bed rest.

When Mrs Thomas was eventually admitted to hospital, she died after being diagnosed with an aggressive form of leukaemia, four days after her last trip to her GP.

GP’s are responsible for their own actions, and for the acts of their employees and of anyone else they employ to look after patients.

Some examples of GP negligence include:

  • failing to refer to hospital or a specialist for further investigation into symptoms
  • failing to act upon test results
  • failing to diagnose illness or injury correctly
  • prescribing the incorrect medication.

It was reported earlier this year, that NHS Scotland has paid out more than £350m over the past ten years in relation to medical negligence claims with £200m of that being paid out over the past five years.

To claim compensation for GP negligence you have to be able to prove that whatever the doctor did (or didn’t do) fell below a reasonable standard of care expected of a competent doctor. It also must be proven that that the failure to correctly diagnose an illness or injury either directly caused the illness or injuries described, or have contributed to them.

There is a three year time limit for making a claim for compensation and raising legal proceedings for medical negligence resulting in physical or psychiatric injury. It is therefore essential that if you have experienced negligence by a GP or any other healthcare professional you seek expert legal advice as soon as you can.
