Drafting and serving notices
The legal rules regarding termination of a tenancy are complex and strict. One mistake during the process can cause months of delays and increased costs. It can be difficult to draft the appropriate notices correctly and to ensure that they contain the proper information and are served in a timely manner, particularly given the existence of different tenancy regimes and the notice provisions in respect of each.
Depending on the type of tenancy you have, we can offer a fixed fee service to cover the drafting and serving of the relevant notices.
Tribunal actions for eviction and payment
If a tenant fails to leave a property following the expiry of notices, it is necessary to apply to the First-tier Tribunal for Scotland (Housing and Property Chamber) for an eviction order. We can help by drafting and serving the court papers and arranging to represent you at the tribunal. Depending on the circumstances, we can offer a capped fee for this work.
Enforcement/debt recovery
Once an order has been granted for eviction and/or payment of rent arrears we liaise with Sheriff Officers on your behalf to arrange for enforcement. Our Debt Recovery Team can advise you on the relevant procedures and will take matters forward on a fixed fee basis.
